1. Eligibility. The Churchill Downs Scratch Off Promotion is open to legal residents of the United States who are eighteen (18) years of age or older, except those residing in Rhode Island, Vermont, Florida, New York or where restricted or prohibited. No reproductions, facsimiles or photocopies will be allowed and will result in disqualification. Limit one game piece per person. Current and former employees of Churchill Downs and its advertising agencies, members of the media, stable personnel, employees of the Commonwealth of Kentucky Horse Racing Authority, printers, and companies involved with the creation or distribution of the Churchill Downs Scratch Off Game piece are not eligible to participate in this promotion.
2. Distribution of Game Pieces. One game piece will be given to the first 4,005 patrons 18 years or older at Gates 1, 10 and 17 of Churchill Downs Racetrack on May 11, 2008 beginning at 11:30 a.m. eastern standard time and ending at 5:00 p.m.. No purchase necessary. Limit one game piece per person.
3. How to play. To reveal their prize, customers must scratch off the prize area on the game card. Contestants will win the prize revealed. Prizes must be claimed by 6:30 p.m. eastern standard time on May 11, 2008 with exception of the .50% bonus rate on a new Certificate of Deposit offered by Forcht Bank; this offer is valid through August 31, 2008. No other giveaway claims will be honored after the promotion. Limit one prize per person.
4. Prize Breakdown. No prizes can be exchanged for cash. Unclaimed prizes will not be awarded. The prize breakdown is as follows: A quantity of five (5) players will receive (2) 2009 Derby tickets in Millionaires Row, accommodations at the Galt House and a $1,000 Visa gift card. Other prizes include a free soft serve ice cream cone (500 total), a free Fischer's jumbo hot dog (500 total), a free regular Pepsi product (500 total) and .50% bonus rate on a new Certificate of Deposit at any Forcht Bank location with a minimum $10,000 deposit. Valid through 8/31/2008.
5. Taxes. Liability for any and all federal, state, and local taxes rest solely with the prize winners. Any winner holding a game piece valid for any prize worth $500 or more must sign an official affidavit, confirming compliance with these rules and regulations of the promotion, and fill out a W-9 form for tax purposes.
6. Judging. Churchill Downs management reserves the right to interpret all questions and conditions regarding this event, without claim for damages or recourse of any kind. All questions not covered in these rules will be decided by the management of Churchill Downs, its decision to be final. In the event that the scratch-off cards are unable to be scratched off due to deficient screening ink on the game cards, deficient printing of game cards, or other potential malfunction of the scratch-off game cards, each person redeeming their game card will be asked to complete a name and address form. All game cards redeemed that are unscratchable or otherwise unreadable will be given a random prize selected from the assortment of non-cash prizes available.
7. General. By participating in this promotion and accepting the prize, winner(s) release Churchill Downs and it's affiliates, subsidiaries, advertising, promotional and production agencies from any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred and including, without limitation, lost mail, a lost or damaged Game Piece, property damage, personal injury and/or death which may occur in connection with acceptance and/or use of the prize. By participating in this promotion, winners also grant Churchill Downs permission to use name and photo for promotional purposes.

If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.
