1. Churchill Downs Incorporated will conduct a tiered drawing for the opportunity to purchase 2010 Kentucky Oaks tickets and 2010 Kentucky Derby tickets. The drawing will take place on or before December 31, 2009.
2. Applications for the opportunity to purchase 2010 Kentucky Oaks tickets and 2010 Kentucky Derby tickets will be taken at www.churchilldowns.com, www.kentuckyderby.com and www.twinspiresclub.com.
3. All applicants are required to be Twin Spires Club members. The Twin Spires Club is free to join. No purchase necessary.
4. Twin Spires Club membership is open to legal residents of the 50 United States and the District of Columbia who are of legal wagering age in their state or district of residence, except where restricted by law or prohibited. The online ticket drawing is not open to employees of Churchill Downs and its subsidiaries, contractors, advertising agencies, racing officials and their immediate family members, including spouse, children, parents and siblings.
5. On or before December 31, 2009 an allotment of no less than 2,500 of 2010 Kentucky Oaks tickets and no less than 2,500 of 2010 Kentucky Derby tickets will be preserved by Churchill Downs Incorporated for its Twin Spires Club members to purchase tickets through an online application process. The drawing will be conducted at Churchill Downs on or before December 31, 2009 and will include all eligible Applicants (as defined below).
6. “Applicants” will herein be defined as all eligible Twin Spires Club members who have applied to this online ticketing program through www.churchilldowns.com, www.kentuckyderby.com or www.twinspiresclub.com.
7. The first tiered drawing will consist of 65% of the allotted Kentucky Oaks tickets and Kentucky Derby tickets for Applicants that have earned at least 65,000 Twin Spires Club points during the evaluation period.
8. The second tiered drawing will consist of 20% of the allotted Kentucky Oaks tickets and Kentucky Derby tickets for Applicants that have earned between 30,000 and 65,000 Twin Spires Club points during the evaluation period.
9. The third tiered drawing will consist of 15% of the allotted Kentucky Oaks and Kentucky Derby tickets for Applicants that have earned between 10,000 and 30,000 Twin Spires Club points during the evaluation period.
10. Each of the three tiered drawings will be conducted on or before December 31, 2009. Within each tier, as listed above, Applicants will be ranked according to TSC points earned during the evaluation period and, unless the number of Applicants within a specific tier exceed the number of tickets allotted to such tier, Applicants will have the opportunity to purchase tickets based on such ranking and the excess tickets will be redistributed to the next highest tier for consideration to those Applicants meeting the requirements of that tier. If the number of Applicants within a specific tier exceed the number of allotted tickets in the respective tier then Applicants within such tier will be selected randomly for the right to purchase tickets and any Applicants who are not awarded the right to purchase tickets in a specific tier will drop down to the next highest tier for consideration, if applicable.
11. In the online application, you will submit the number of tickets between two (2) and six (6) that you would like to purchase. Your request for a certain amount of tickets may or may not be wholly fulfilled as fulfillment will be based on available inventory and the number of eligible Applicants who have registered for this online ticketing program.
12. The ticket allotment dedicated to this online ticketing program will be grandstand seating.
13. The only notice given to winning Applicants will be an invoice from Churchill Downs for 2010 Kentucky Oaks tickets and Kentucky Derby tickets that will be payable by the end of January, 2010 (exact date to be announced). Any invoice that is not paid in full by the due date indicated on the invoice or has received approval by the Ticketing Department will be subject to forfeiture of the rights to purchase the tickets and will be offered to the next eligible applicant on the waiting list, if any.
14. A waiting list will be established for those not selected in any of the three separate tiers for any additional Kentucky Oaks tickets and Kentucky Derby tickets that may become available. The ranking order of the waiting list will be established by how many Twin Spires Club points an Applicant has earned during the evaluation period. The Applicant with the most earned points during the evaluation period will be notified by receiving an invoice form Churchill Downs via US Mail if tickets should become available. The opportunity to purchase tickets will be extended to the next eligible Applicant on the waiting list until all tickets in the allotment have been offered for sale and purchased.
15. All Twin Spires Club members selected for the opportunity to purchase tickets through any of the three tiered drawings or the wait list process must purchase an equal number of Kentucky Oaks tickets and Kentucky Derby tickets. No exceptions.
16. The evaluation period for earning Twin Spires Club points counting toward the total needed to qualify for the above tiered drawings is January 1, 2009 through November 30, 2009.
17. Twin Spires Club points for this program will include those points earned through wagering (on-track, simulcast or via TwinSpires.com) and any promotional points including VIP Monthly Bonus points and Derby Visa points. Points received by a Twin Spires Club member pursuant to the uncashed ticket program will not be included when determining such member’s applicable tier for the Kentucky Oaks and Kentucky Derby ticket drawing or otherwise ranking such member for the right to purchase such tickets.
18. The deadline for applying for 2010 Kentucky Derby and Oaks tickets is 11:59 p.m. ET on November 30, 2009.
19. Decisions of the judges and officials of Churchill Downs Incorporated are final.
